Impressions of the Luther Lecture 2024
Soft Law in International Commercial Arbitration - A Critical Approach
About the Lecture
Prof. Dr. Felix Dasser gave the 7th Luther Lecture on 18 March 2024!
Rules and guidelines in the field of arbitration have been proliferating for years - some of these "soft laws" are widely recognised and even treated as "hard laws", while others lack legitimacy.
Felix Dasser examined this fascinating phenomenon from all sides. Do we really need a 30-page set of Rules of Procedure that incorporates all the current soft procedural law? Or should we simply use soft law as a useful stone quarry depending on the needs of the specific case? How do we determine what may qualifies as soft law and what does not? Or is soft law just a fata morgana anyway?
